All direct payment gateways offered by wix.com and used by our business adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. 

 

We may contact you via e-mail, telephone, postal mail, or text to collect payment, resolve disputes, confirm order details, provide order or rental updates and confirmations, provide surveys for feedback and to resolve order issues.

Terms & Conditions 

 

This website is owned and operated by Back Forty Basecamps LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. The website offers visitors outdoor recreational products for purchase and for rent. We also offer our reservations and booking order form for specific wall tent rentals involving set-up and take-down service within Kittitas County, Washington. By accessing or using this website, you agree that you have read, understood, and agree to be bound by these Terms. 

 

In order to receive our services you must be at least 18 years of age and possess the legal authority, right and freedom to enter these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. 

 

Commercial Terms: 

 

When purchasing an item, rental, or service from our business you agree that you are responsible for understanding the product description before making a commitment to buy or rent it. You enter into a legally binding contract to purchase or rent an item when you complete the check-out process. 

 

The prices we charge for services and products are listed on the website and/or order form. We reserve the right to change our prices at any time. Taxes will be calculated and assessed based on applicable tax rates and laws. 

 

Return, Refund, and Cancellation:

 

For any undamaged product (that was purchased, not rented) that you wish to return, return it with the original packaging along with the original receipt. Returns are only accepted within 14 days of the date you receive the product for purchase. The refund will be provided via the original payment method unless otherwise arranged. Contact us via e-mail at backfortybasecamps@gmail.com to initiate the return process. Return shipping cost will be the responsibility of the customer. The refund will be sent for processing upon receipt of the returned product in undamaged condition. 

 

All rentals and rental packages are required to be paid in full at the time the order is placed to reserve the reservation. No refunds will be offered if rental is canceled within seven days from the first date of the rental period. A cancellation outside of the seven calendar day period will result in a refund, less 15%. The customer is responsible to maintain rented gear, equipment, and items in good condition. The customer is responsible for the replacement cost of all items that are returned damaged at the end of the rental period. This cost of replacement will be due within 7 days following our receipt of damaged rental items.

 

We may, without notice, change the services offered or stop providing the services, as well as create limits. We may suspend access to the services provided or terminate the service provided without notice and liability for any reason. 

 

Ownership of intellectual property, copyrights, and logos:

 

The service and all materials therein or transferred thereby including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos and all intellectual property rights related thereto, are the exclusive property of Back Forty Basecamps LLC. Nothing in these terms shall be deemed to create a license in or under any such intellectual property rights, and you agree not to sell, rent, license, modify, distribute, copy, reproduce, edit, or create derivative works thereof. 

 

Indemnity:

 

You agree to indemnify and hold Back Forty Basecamps LLC harmless from any demand, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising from, or in connection with your use of the website or any of the services or products offered on the website. 

 

Limitation of liability:

 

To the maximum extent permitted by applicable law, in no event shall Back Forty Basecamps LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service or products.

 

To the maximum extend permitted by applicable law, Back Forty Basecamps LLC assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, personal injury or property damage, resulting from your access or use of our service (including third parties using your rented equipment, service, or purchased product), and any unauthorized access to or use of our secure servers and/or any and all personal information stored therein. 

 

Additional Terms for Services Offered:

 

The customer is aware all items ordered are subject to availability whether that be due to inventory or date range availability. They further understand that a representative of Back Forty Basecamps LLC will contact them via e-mail and/or phone to confirm order details, provide total cost, and make arrangements for payment (Check, money order, and major credit cards accepted).

 

All rentals and rental packages are required to be paid in full at the time the order is placed to reserve the reservation. The customer is responsible to maintain rented gear, equipment, and items in good condition. Basecamp reservations will be available for use starting at 1pm on the first day of the reservation up until 11am on the last day of the reservation period. All rental items to include the wall tent, accessories, and requested add-ons are expected to be maintained in good condition throughout the time of the rental. If Back Forty Basecamps LLC determines the wall tent and any add-ons, or any other item rented, are damaged to the point of needing repair or replacement at the conclusion of the rental period, the cost of doing so will be the responsibility of the customer to be paid within 7 days by the customer after we receive the damaged item(s). 

 

The customer acknowledges that requested basecamp locations may not be available and that alternate locations may be necessary. All requested locations must be accessible via legal road (pavement, dirt, gravel, improved road). If set-up is requested on private land, the customer will ensure permission is granted by the property owner for Back Forty Basecamps LLC to set-up the rental on their land. The US Forest Service has a maximum camping stay of 14 days. Customers will be required to abide by restrictions. 

 

The customer and all participants utilizing the equipment and gear provided by Back Forty Basecamps LLC agree to hold Back Forty Basecamps LLC harmless for any liability associated with the use of the wall tent rental and any requested add-ons. 

 

The customer and all associated parties waive and release any and all claims known now or hereafter against Back Forty Basecamps LLC on account of injury, disability, illness, death, and property damage arising from their participation in the use of any and all products provided by Back Forty Basecamps LLC. The customer and all associated parties acknowledge that they are voluntarily participating in the use of items provided by Back Forty Basecamps with the knowledge of the dangers involved. Safely navigating roads and terrain to access camp locations is the responsibility of the customer. Back Forty Basecamps LLC and all landowners affected are not responsible for injury, death, property damage or any other loss from a customer and their participants travel to, from, and at the camp location or in any other connection to the item rented. 

 

Customers and participant users of our rental equipment and service are required to treat the land they are staying on with respect. Damage to the land, property, vegetation, and environment whether that be on public or private land is not allowed. Customers and participants will leave the campsite in the same or better condition than they found it. Customers and participants are responsible for removing all trash from the premises by the end of their rental period. 

 

Any item that is rented is required to be returned in good working condition. By participating in the service, the customer acknowledges they are responsible for the cost of all damages to rental items occurring during their rental period. Further, all rental items shipped to a customer are required to be returned with the original packaging (If packaging is damaged - the customer is responsible for the cost replacement packaging to ship back). The customer is required to, and agrees, to return all items to the nearest parcel delivery service with appropriate packaging and labeling no later than one business day following the last day of the rental period. Failure to do so will result in additional charges for the customer to pay in full for the replacement cost of the item rented. 

 

Right to Change Terms:

 

We reserve the right to modify these terms at anytime. Therefore, you should review these pages periodically. It is your responsibility to read the terms and conditions periodically to be familiar with any changes that may have been made. Your continued use of the website or our service after any changes to our terms and conditions constitutes your acceptance of the new terms and conditions. If you do not agree with the terms and conditions, do not use or access the website, services, or products.
